HIPAA Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

B Mental Health Evolution is committed to protecting the privacy of your protected health information (“PHI”). This Notice describes our legal duties, your rights, and permitted uses and disclosures.

Your Rights

  • Inspect and obtain a copy of your medical record and other PHI, subject to applicable law.
  • Request an amendment when you believe PHI is inaccurate or incomplete.
  • Request confidential communications by alternative means or locations.
  • Ask us to restrict certain uses or disclosures, although we are not required to agree to every request.
  • Request an accounting of certain disclosures.
  • Receive a copy of this Notice.
  • Choose someone to act for you when legally authorized.
  • File a complaint with us or the U.S. Department of Health and Human Services Office for Civil Rights without retaliation.

How We May Use and Disclose PHI

Treatment

We may use or disclose PHI to provide, coordinate, or manage healthcare and related services.

Payment

We may use or disclose PHI to obtain payment for services and related payment activities.

Healthcare Operations

We may use or disclose PHI for quality assessment, compliance, credentialing, training, business management, and improving care.

Other Permitted or Required Disclosures

We may use or disclose PHI when permitted or required by law, including for certain public health activities, health oversight, legal proceedings, law enforcement, reporting abuse or neglect, preventing certain serious threats, workers’ compensation, and other legally authorized purposes.

Authorizations

Uses and disclosures not otherwise permitted or required generally require your written authorization. You may revoke an authorization in writing as allowed by law, although revocation may not affect actions already taken.

Psychotherapy Notes, Marketing, and Sale of PHI

Additional authorization requirements may apply to psychotherapy notes, certain marketing activities, or disclosures involving the sale of PHI. We will follow applicable requirements.

Substance Use Disorder Records

Where applicable, specially protected substance use disorder records may be subject to federal requirements under 42 U.S.C. § 290dd-2 and 42 CFR Part 2.

Our Responsibilities

We are required by law to maintain the privacy of PHI, provide this Notice, follow the Notice currently in effect, and notify affected individuals as required following a breach of unsecured PHI.

Telehealth and Electronic Communications

Telehealth and electronic communications involve technology and security risks. We use appropriate safeguards for systems we control, but no electronic communication method can be guaranteed completely risk-free.

Changes to This Notice

We may change this Notice. Material revisions will be made available as required by applicable law and posted on our website.
